Debtor Creditor Disputes

Business owners and professionals today should consider planning for protection of their property from creditors, litigation, and changes in financial circumstances. At DS&L, we work with our clients on a very personal basis to help determine if asset protection planning is appropriate for them, and what each plan should accomplish. In the many cases, the plan is to ensure that assets are titled correctly and proper insurance is in place. However, some clients will require higher levels of service which may include establishing limited partnerships, trusts, and controlled giving, among other options. In all cases, it is vitally important that the planning takes place before claims are made against you. We urge clients to be cautious of marketers offering one-size-fits-all plans which frequently do not work, and may be illegal.
